Justice Stevens ought to be laughed out of the court for brazen incoherence. If its local there is no interstate, and so far as the specifics of the case go there wasn't even a market.
If there's no trade going on it ought to have been a matter of privacy precedents, in which case, per Lawrence and Garner v. Texas, it would have gone 6-3 the other way, or if the states rights folks kept to that particular schtick, 9-0. As it is this ruling is pretty much just endorsing "Congress' power to regulate the lack of intrastate markets", which amounts to "Congress' power to regulate whatever the fuck they want to".
